Thank you for using Dizzy, a digital application developed by Dizzy Team. This User Agreement ("Agreement") outlines the terms and conditions governing your access to and use of Dizzy. By engaging with the Application, you signify your acceptance of all provisions herein. If you do not agree with these terms, please refrain from using Dizzy.
1.1 Age Requirement
· To register for Dizzy, you must be at least 17 years of age. This requirement ensures that all users possess the legal capacity to understand and comply with the terms of this Agreement.
1.2 Account Creation
· Creating an account requires providing accurate, current, and complete information, including a valid email address and a secure password. You are obligated to maintain the accuracy of your account details and promptly update any changes to ensure uninterrupted service and security.
1.3 Account Security
· You are solely responsible for maintaining the confidentiality of your account credentials. In the event of suspected unauthorized access or a security breach, you must immediately notify Dizzy Team at SonPhamho0430@hotmail.com. Failure to safeguard your account may result in suspension or termination to protect your interests and the integrity of the platform.
2.1 Legal Compliance
· Your use of Dizzy must comply with all applicable local, national, and international laws, regulations, and ordinances. Prohibited activities include, but are not limited to, fraud, copyright infringement, and any form of illegal data processing.
2.2 Prohibited Actions
· You agree not to:
• Upload, post, or transmit content that is harmful, defamatory, discriminatory, or illegal;
• Interfere with Dizzy’s technical infrastructure, including through hacking, denial-of-service attacks, or data scraping;
• Engage in harassment, spamming, or any form of abusive behavior toward other users or Dizzy Team representatives.
2.3 Intellectual Property Rights
· All content within Dizzy, including but not limited to logos, designs, software, and features, is the intellectual property of Dizzy Team or its licensors. You may not reproduce, modify, distribute, or commercially exploit such content without prior written consent.
3.1 Data Handling Practices
· Dizzy Team’s approach to collecting, storing, and using your personal information is detailed in our Privacy Policy, which is incorporated into this Agreement by reference. By using Dizzy, you consent to the data practices described in the Privacy Policy.
3.2 Collected Information
· We may collect usage data, device information, account details, and other relevant metrics to enhance your user experience, improve service functionality, and implement security measures. This data is processed in compliance with applicable privacy laws.
3.3 Third-Party Integrations
· Dizzy may include links to third-party services or platforms. Please note that we do not control these external services, and your interaction with them is governed by their respective terms and privacy policies. Use of third-party services is at your own risk.
4.1 User License
· Dizzy Team grants you a limited, non-exclusive, non-transferable license to use Dizzy for personal, non-commercial purposes. This license does not permit you to resell, sublicense, reverse-engineer, or modify the Application.
4.2 Content Ownership
· You retain ownership of the content you submit to Dizzy, but you grant Dizzy Team a royalty-free, worldwide license to use, display, and distribute such content for the purpose of operating and improving the Application.
5.1 Actions by Dizzy Team
· Dizzy Team reserves the right to suspend or terminate your account without prior notice if you violate this Agreement, engage in illegal activity, or misuse the Application. Such actions are taken to protect the safety and integrity of the Dizzy community.
5.2 User Termination
· You may discontinue using Dizzy at any time by uninstalling the Application. However, any obligations incurred prior to termination, including indemnification and data retention clauses, will remain in effect.
6.1 Warranty Disclaimer
· Dizzy is provided "as is" and "as available," without any warranties of any kind, express or implied. We do not guarantee that the Application will be error-free, uninterrupted, or secure.
6.2 Limitation of Liability
· In no event shall Dizzy Team be liable for any indirect, consequential, or punitive damages arising from your use of Dizzy, including but not limited to data loss or business interruption.
6.3 Indemnification
· You agree to indemnify and hold Dizzy Team, its affiliates, and their respective officers, directors, and employees harmless from any claims, damages, or expenses arising from your violation of this Agreement, your use of the Application, or your infringement of third-party rights.
· Dizzy Team may update this Agreement at its sole discretion. Revised terms will be posted on the Application with an updated effective date. Your continued use of Dizzy after such changes constitutes your acceptance of the modified terms. If you disagree with the updates, you must discontinue using the Application.
· This Agreement is governed by the laws of the jurisdiction in which Dizzy Team is incorporated, without regard to conflict of laws principles. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
